1. Who We Are

JANK DB ("the Site," "we," "us," "our") is operated by Wingnut Studios as a free, non-commercial hobby project run by volunteers. We are not a company, LLC, corporation, or any other formal legal entity operating for profit. We accept no payment from users, advertisers, or sponsors of any kind.

JANK DB is not affiliated with, endorsed by, or in any way connected to Wizards of the Coast LLC, Hasbro Inc., or any other official Magic: The Gathering rights holder.

2. Acceptance of Terms

By accessing or using JANK DB in any way — including browsing, creating an account, submitting content, or participating in any feature of the Site — you agree to be bound by these Terms & Conditions. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these terms.

We reserve the right to update these terms at any time without prior notice. The updated terms will be posted on this page with a revised effective date. Your continued use of the Site after any such changes constitutes your acceptance of the new terms.

3. Eligibility

You must be at least 13 years of age to use this Site. By creating an account you represent that you meet this age requirement. Users under 18 should have parental or guardian consent before registering.

4. Free Service — No Fees, No Refunds

JANK DB is and always will be free to use. We do not charge for accounts, features, or content. Because no money is ever exchanged between users and Wingnut Studios, there is nothing to refund, charge back, or dispute financially. We have no obligation to maintain the Site, keep it available, or continue operating it at any time.

5. No Warranties — "As Is" Service

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. This includes, without limitation:

• No warranty of merchantability, fitness for a particular purpose, or non-infringement.
• No warranty that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• No warranty that card data, pricing information, legality data, set information, or any other content is accurate, complete, current, or reliable. Card prices displayed are sourced from third parties and are for informational purposes only — they are not offers to buy or sell.
• No warranty that user accounts, collection data, deck data, or any other user-generated content will be preserved, backed up, or recoverable.
• No warranty that the Site will remain available or continue to exist in any form.

You use the Site entirely at your own risk.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WINGNUT STUDIOS AND ITS VOLUNTEERS, CONTRIBUTORS, AND OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, including but not limited to:

• Loss of data, collection records, deck lists, or account information.
• Financial loss arising from card pricing information displayed on the Site.
• Damages arising from trades, exchanges, or any in-person or online transactions facilitated or suggested by the Site.
• Damages from unauthorized access to your account or data.
• Damages from Site downtime, errors, bugs, or discontinuation.
• Any other damages arising out of your use of or inability to use the Site.

This limitation applies regardless of the legal theory (tort, contract, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the fullest extent permitted by law. Because JANK DB charges nothing, in no event shall our total aggregate liability to you exceed zero dollars ($0.00).

7. Trades and In-Person Transactions

JANK DB provides tools to help players express interest in trading cards with one another. We are not a marketplace, broker, escrow service, or intermediary for any transaction. We do not hold, transfer, or guarantee the delivery of any physical cards or goods.

All trades and exchanges facilitated through the Site are conducted entirely between users and/or local game stores at their own risk and discretion. Wingnut Studios is not a party to any trade, bears no responsibility for its outcome, and cannot mediate disputes. You acknowledge that trading physical goods carries inherent risks — including fraud, loss in transit, and disagreements over card condition — and you assume all such risks entirely.

8. User Accounts and Content

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

By submitting any content to the Site (including deck names, forum posts, profile information, or any other user-generated material), you grant Wingnut Studios a non-exclusive, royalty-free, worldwide license to store, display, and distribute that content in connection with operating the Site. You represent that you own or have the necessary rights to any content you submit.

You agree not to submit content that is unlawful, defamatory, harassing, obscene, or that infringes any third-party intellectual property rights.

9. Intellectual Property — Magic: The Gathering

Magic: The Gathering, all card names, card art, set names, and related intellectual property are the property of Wizards of the Coast LLC. JANK DB is an unofficial fan project and is not affiliated with or endorsed by Wizards of the Coast or Hasbro. Card images and data are used under the assumption of fair use for community, non-commercial purposes.

If you are a rights holder with a concern about content on this Site, please contact us and we will respond promptly.

10. Third-Party Data and Links

The Site may display data sourced from third-party services (including card databases, pricing APIs, and set data providers). We do not control the accuracy, completeness, or availability of third-party data and are not responsible for any errors or omissions in that data.

The Site may contain links to external websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party site.

11. Privacy

We collect only the information necessary to operate the Site (account credentials, collection data, etc.). We do not sell, rent, or share your personal information with advertisers or third parties for commercial purposes. We have no advertising partners and display no ads.

You acknowledge that no method of data transmission or storage is 100% secure. We cannot guarantee absolute security of your data.

12. Termination

We reserve the right to suspend or terminate any account at any time, for any reason or no reason, with or without notice. Reasons may include (but are not limited to) violation of these terms, abusive behavior, or operational decisions. Upon termination, your right to use the Site ceases immediately. We have no obligation to preserve or return any data associated with a terminated account.

You may delete your account at any time by contacting us.

13. Indemnification

You agree to indemnify, defend, and hold harmless Wingnut Studios and its volunteers, contributors, and operators from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site; (b) your violation of these terms; (c) your violation of any third-party right; or (d) any content you submit to the Site.

14. Governing Law and Disputes

These terms are governed by and construed in accordance with the laws of the United States. Any dispute arising from these terms or your use of the Site shall first be attempted to be resolved informally by contacting us. If informal resolution fails, disputes shall be resolved through binding individual arbitration rather than in court, to the extent permitted by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Volunteer-Run Service — No SLA

JANK DB is maintained by unpaid volunteers in their spare time. We make no commitment to response times, uptime, feature delivery, bug fixes, or continued operation. The Site may go down, change significantly, or cease to exist entirely at any time without notice. This is a labor of love, not a commercial service.

16. Entire Agreement

These Terms & Conditions constitute the entire agreement between you and Wingnut Studios regarding your use of the Site and supersede all prior agreements or understandings. If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
